1. Acceptance of Terms

By accessing or using the OperationsLens platform ("Service"), operated by Buildgrid Oy ("we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

OperationsLens is an AI-powered customer support platform that provides ticketing, live chat, knowledge base, and workflow automation tools. The Service is provided on a subscription basis with various plans offering different features and usage limits. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information to keep it accurate.
  • Maintain the security and confidentiality of your password and account credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Service in any way that violates applicable laws or regulations.
  • Use the Service to send spam, unsolicited communications, or malicious content.
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems.
  • Interfere with or disrupt the Service or servers and networks connected to the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use the Service to store or transmit malicious code, viruses, or harmful data.
  • Resell, sublicense, or redistribute the Service without our written consent.
  • Use the Service in a manner that could damage, disable, or impair the Service.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Buildgrid Oy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of all content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to use, process, and store that content solely for the purpose of providing and improving the Service. We will not use your User Content for any other purpose without your explicit consent.

6. Payment Terms

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to the following:

  • Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen billing cycle.
  • All fees are quoted in euros (EUR) unless otherwise stated and are non-refundable except as specified in our refund policy.
  • We offer a 14-day money-back guarantee on all paid plans. Refund requests after this period will be handled on a case-by-case basis.
  • Your subscription will automatically renew unless you cancel it before the renewal date.
  • We reserve the right to change subscription fees with 30 days' advance notice. Existing subscriptions will be honored at the current rate until the next renewal.

7. Termination

You may terminate your account at any time by contacting us or using the account settings within the Service. We may terminate or suspend your access to the Service immediately, without prior notice, if:

  • You breach any provision of these Terms.
  • Your use of the Service poses a security risk to the Service or other users.
  • We are required to do so by law.

Upon termination, your right to use the Service will immediately cease. You may request an export of your data within 30 days of termination. After 30 days, we may delete your data in accordance with our data retention policy.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Buildgrid Oy and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.

Our total liability for all claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. AI-powered features provide suggestions and recommendations that may not always be accurate. You acknowledge that AI outputs should be reviewed by humans before being acted upon.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of Helsinki, Finland. Notwithstanding the foregoing, you agree that we may seek injunctive relief in any court of competent jurisdiction.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide at least 30 days' notice before any material changes take effect. Notice will be provided by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will also notify registered users by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
